Telekom Austria made a filing with the country’s Federal Competition Authority ahead of its planned acquisition of operator Yesss, noting that a “potential second phase” review may take the process to the end of 2012.

In a shake-up of the country’s mobile market, 3 Austria is set to acquire rival Orange Austria from current owners Mid Europa Partners and France Telecom. Hutchison will then sell on Yesss, which is currently owned by Orange Austria, to market leader Telekom Austria.

However, there have been reports that the Austrian regulators have concerns over the deal, due to the fact that it will see Telekom Austria cementing its leadership in the market through the Yesss deal – which will give it a market share approaching 50 percent.

It has been mooted that the Yesss transaction is critical for ensuring the continued support of 3 Austria’s owner, Huchison Whampoa, which may otherwise walk away from the deal.

In a statement, Telekom Austria said that on 7 May 2012, Hutchison 3G Austria filed a notification with the European Commission detailing the proposed transaction. Its current filing with the Federal Competition Authority means that “both proceedings can be concluded approximately at the same time.”

The EC recently extended a deadline for a ruling on the proposed transaction to 29 June 2012.
