Apple has lost an appeal against a decision that rules that Samsung did not infringe its design rights with its Galaxy Tab device, reports the BBC.

The appeal judges upheld a High Court judgement in July that the Galaxy Tab did not echo the designs that Apple registered for its iPad closely enough to support Apple’s case.

The High Court judge said in July that the Samsung devices lacked the “extreme simplicity” of the Apple devices and were therefore not as “cool”.

As part of the original decision, Apple was required to run ads making it clear that Samsung had not infringed its design rights and place a link to the judgement on its website. The aim was to “correct the damaging impression" that the legal action had created for Samsung.

The current ruling applies across the EU, although Apple can still appeal the decision in the UK Supreme Court.
