T-Mobile Austria, owned by Deutsche Telekom, has filed a complaint to the national regulator that terms attached to some of the spectrum being planned for auction in September should be changed.

According to a Reuters report, T-Mobile Austria says that some spectrum – the report does not identify the frequency bands – should not be made available in 2016 (as the regulator promises) as the operator has licence rights on it until 2019.

Ewald Lichtenberger, a lawyer acting for T-Mobile, told Reuters: “This is an issue that I believe must be clarified before the auction because later it would create big problems.”

TKK, the regulator, is planning an auction of 28 frequency blocks of 800 MHz, 900 MHz and 1,800 MHz spectrum in September.

Minimum bids for the total have been set at €526 million.
