Samsung has countersued Ericsson and asked that the lawsuit filed against it by the Swedish infrastructure vendor is thrown out by the US Federal Court Texas due to the claims being invalid, reports Reuters.

Ericsson’s patent infringement lawsuit against Samsung filed in November last year alleged that the South Korean company was unlawfully using its technology and had breached an agreement to extend a licensing deal after several years of negotiations.

However, Samsung said in its new filing that Ericsson has engaged in “a pervasive and pernicious pattern of refusing to grant licenses to Samsung on fair, reasonable and non-discriminatory terms”.

Ericsson’s lawsuit said that it offered to extend its previous licensing deal with Samsung on those terms, but the South Korean company had refused.

The companies have also filed complaints against each other in the International Trade Commission concerning the same patents with Ericsson reportedly requesting a US import ban for Samsung products.
