Sportswear company Nike proposed a settlement for a class action lawsuit against it and Apple, related to the accuracy of its Fuelband fitness tracker.

The suit alleges that the two companies “engaged in violations of consumer protection laws in connection with the Nike+ Fuelband”. It said that this relates to “false and/or misleading statements…made regarding the Nike+ Fuelband’s ability to accurately track calories, steps and [proprietary fitness tracking unit] NikeFuel”.

Nike is now proposing either a $15 payment or $25 gift card in settlement.

Earlier this year, the Journal of the American Medical Association found that the product gave the widest set of results in trials, and was the most prone to under-reading.

According to reports last year, Nike has already ramped-down its wearables effort as far as its own-brand hardware is concerned.

The existing Fuelband SE remains available through some channels, and Nike offers apps which work with other devices.
